Did you know the person workers' compensation hires to drive you to and from an IME (Independent Medical Exam) most often are the same private investigators they hire to follow and videotape you. Everything you say and do on the ride to and from the IME, most often is being recorded and could be used against you.
You may be surprised when you read about some of the tactics private investigators use to get injured workers off workers’ compensation. One way the private investigator may try to entrap an injured workers is to place a few dollars or a handful of change on the front steps or pavement outside injured workers house or in front of the injured workers car door, then wait to videotape them bending over or kneeling down to pick up the money.

Always remember that the less workers’ compensation knows about your personal life, the better off you are. Don’t let the insurance company know if you’re going out of town or on vacation; it‘s none of their business.
Be careful what you say to your physician; it may end up in your medical records, and they send copies of the records to the workers’ compensation insurance company. You don’t want to give the insurance company any more information about your personal life then you have to.
If you have problems with the workers compensation insurance company and you don’t have an attorney, file a complaint with the Insurance Review Board. (You can find the number for the Insurance Review Board in the government pages of your local phone book.) They will contact your workers’ compensation insurance company to try to resolve the problem.
If the doctor tells you to take over-the-counter medication, request a prescription for an equivalent drug. The insurance company is obligated to pay a in hole or percentage of the cost of prescriptions, but not for over-the-counter medicines, and the cost can add up fast.
I the insurance company assign a rehab counselor to attend doctor appointments with you, you do not have to let the counselor in the room with you make them pay for a second appointment for them to talk to the doctor most often they wont.
Always remember that the insurance company may be watching you, especially on days when you may feel good enough to do more than usual. They may view this as evidence that you are faking your disability.
If you notice that a private investigator is following you, walk up to the vehicle they’re in and ask if you can help them. If you have a camera, get as close to them as possible and start taking pictures; they don’t like having their pictures taken. Then stay out of sight. They will probably leave, but be certain they will be back, possibly in a different vehicle.
If you move to a new house while off work with your injury, only inform workers’ compensation after you have moved. If you tell them before you move, they will have someone watching you.
You should try to keep a low profile and stay out of sight. Don’t wash your car, take out the trash, do any type of yard work, or carry anything, in case you’re being watched. Anyone who’s been injured knows that you may have good days and bad days, but the insurance company will not see it that way. Even if an activity is allowed within your medical restrictions, it’s not worth the chance that someone may be filming you and may try to use it against you in court.
At some point the insurance company may take you to court. You should make the best of it, since you will have to pay for an attorney and doctor’s depositions. Try to make the insurance company pay for it. For instance, if you have a back or knee problem and you would get relief from using a hot tub, have your doctor write you a prescription for a hot tub. Then tell your attorney to ask the doctor how you would benefit from a hot tub during the deposition, and submit it in court. All the judge can do is say yes or no. If the judge says yes, the workers’ compensation insurance company will have to buy you a hot tub. You can try this with anything you need—someone to cut your lawn or do whatever you are unable to do. As long as you are going to pay for attorney fees and doctor depositions, make it worthwhile.
